Basis for Termination

Certain situations arise when terminating a parent’s rights may be appropriate and in the best interests of the child. There must be a statutory basis under Iowa Code Chapter 600A to terminate parental rights.

For example, a party may seek a termination of parental rights when:

  • One parent does not have substantial and continuous or repeated contact with the child
  • One parent does not physically or financially support the child
  • There have been instances of neglect or abuse

Only a judge is able to terminate an individual’s parental rights. In a majority of cases, judges are asked to terminate parental rights by whoever has been taking care of the child or by the state. However, a judge will not terminate someone’s parental rights simply because they have been asked to do so.

The person requesting the termination needs to show that it is in the best interests of the child that the parental rights of the other parent are terminated. This is the paramount consideration of the Court when making its determination.

Further, all termination of parental rights cases in Iowa require the appointment of a guardian ad litem, also called a GAL. This is an attorney appointed to represent the child’s best interests and to make recommendations to the Court.
